Update: Sheriff Releases Walmart Incident Internal Investigation

Kendall County Board approves settlement of $20,000 for Jason Thurmond, and the rest of the lawsuit involving the altercation with Sheriff's Deputy Craig French will be dropped, according to the Aurora Beacon News.

A Kendall County Sheriff’s deputy was determined to have "lessen(ed) the confidence and esteem" of the department following an internal investigation into an incident in which he drew a gun on a fellow shopper at the Oswego Walmart on Feb. 5 2012. The exchange began when French made remarks to the wife of Jason Thurmond, Nicole Healy-Thurmond, about the number of items the couple had in an express checkout lane, which then escalated into a shoving match initiated by Thurmond after he said French took a step forward. French then drew his gun, stating only afterward that he was a sheriff’s deputy. “French did not display the courtesy and decorum I expect from my employees, and thereby tended to lessen the confidence and esteem of the public …

UPDATE: Kendall County, Sheriff's Deputy Target of Federal Lawsuit in Oswego Walmart Altercation

Jason and Nicole Thurmond of Montgomery are seeking damages in excess of $400,000 after an incident at Oswego Walmart in February 2012.

Almost exactly one year after an off-duty Kendall County Sheriff’s deputy pulled his weapon on a family in line at the Oswego Wal-Mart, the Montgomery couple has filed a federal lawsuit naming the deputy and Kendall County as defendants. Jason and Nicole Thurmond filed the suit Feb. 4. The incident took place Feb. 5, 2012. In the suit, which seeks at least $400,000 in damages, the Thurmonds allege Deputy Craig French used excessive force, assaulted the couple and inflicted emotional distress during the incident in which the Thurmonds and French argued over how many items the Thurmonds had brought to a checkout line. The suit also reveals that during the argument French allegedly chided the couple for allegedly being on public assistance.  …

Seems like typical law enforcement abuse. He had no business pulling a gun or even starting an altercation for that matter. I see people in 20 items or less checkout all the time with too many items, but I don't start altercations over it. Montgomery Man Not Guilty of Battery in Oswego Walmart Altercation

Two-day trial of Jason Thurmond concludes this week.

The criminal trial of a Montgomery man who shoved an off-duty Kendall County Sheriff's deputy on Super Bowl Sunday in February ended this week with a not guilty verdict. Jason Thurmond was found not guilty of battery Tuesday for shoving the officer at the Oswego Walmart on Feb. 5, 2012, according to Kendall County court documents. The trial began on Monday this week when defense attorney Richard Irvin questioned French’s actions, according to the Beacon News. In assessing French’s behavior that day, Irvin pointed out French didn’t identify himself as a police officer until after his gun was drawn. He also never attempted to quiet down other customers, nor did he offer to help Nicole Thurmond, wife of Jason Thurmond, the paper reported. …

Man in Walmart Altercation in Court This Week

Defense goes after off-duty officer who drew his firearm.

The trial for an off-duty Kendall County sheriff’s deputy who got into a scuffle at the Oswego Walmart on Super Bowl Sunday began Monday. Jason Thurmond, 38, of Montgomery, is charged with battery for shoving an off-duty officer at the Oswego Walmart on Feb. 5, 2012. The two got into an argument over a delay at the express line after Thurmond went to retrieve a different carton of eggs during the transaction. According to reports, Kendall County Sheriff's Deputy Craig French, a department veteran who serves as the public information officer, was also in line and he and Thurmond exchanged words. Video of Walmart Altercation Admitted as Evidence

Kendall County prosecutors turned over personnel documents and surveillance video of the Feb. 5 altercation between a Montgomery man and an off-duty Kendall County Sheriff's deputy.

A security video showing an altercation between a Montgomery man and an off-duty Kendall County Sheriff’s deputy on Super Bowl Sunday will be entered into evidence, and may be shown in court, a Kendall County judge decided on Wednesday. Jason Thurmond, 38, was charged with misdemeanor battery after an incident at the Oswego Walmart on Feb. 5 that culminated in that off-duty deputy drawing his gun. Thurmond has said he returned from the aisles to find the officer arguing with his nine-months-pregnant wife, who was in tears. Thurmond admits to shoving the officer to keep him away from his wife, he said, and that’s when the gun was pulled and pointed at Thurmond’s chest, he said. New Judge for Man Charged in Walmart Altercation

In his second court appearance, Jason Thurmond of Montgomery asked for and received a new judge in his misdemeanor battery case. Thurmond was charged after an incident at the Oswego Walmart involving an off-duty Kendall County Sheriff's deputy.

The Montgomery man charged with battery in a scuffle with an off-duty Kendall County Sheriff’s deputy last month made his second court appearance on Monday. Jason Thurmond, 38, was charged with misdemeanor battery after an altercation at the Oswego Walmart on Super Bowl Sunday that culminated in that off-duty officer pulling his gun. Oswego police reported that several officers responded to the Walmart on Route 34 for a fight in progress about noon on Feb. 5. Thurmond has identified the officer as Dep. Craig French, who serves as the public information officer. Couple at the heart of scuffle with Kendall County sheriff's deputy welcomes home baby girl.

The Montgomery man involved in a scuffle with an off-duty Kendall County sheriff’s deputy at the Oswego Walmart on Super Bowl Sunday appeared in Kendall County court Wednesday afternoon. A pre-trial hearing for Jason Thurmond, charged with battery stemming from the incident, ended with a continuation of the case to March 12. Thurmond’s attorney, Richard Irvin of Aurora, said the continuation will allow for time to review surveillance footage from Walmart from the afternoon of Feb. 5. According to an Oswego police report, several police responded to the store on Route 34 for a 911 call of a fight in progress at about noon that day.
