"No Refusal" Enforcement Set for Super Bowl Sunday

Montgomery police will join Kane County in its eighth No Refusal event, during which judges and prosecutors are on call to compel drivers to take breathalyzer tests.

have announced their intention to join Kane County in a “no refusal” day on Super Bowl Sunday.

During a no refusal period, judges and prosecutors from the Kane County State’s Attorney’s office are on standby, ready to draft and serve warrants to force drivers to take a breathalyzer test, or give a blood sample. The idea, according to State’s Attorney Joe McMahon, is to thwart drunken driving suspects trying to evade prosecution by refusing the tests.

While refusing the test is illegal, it can sometimes be to a repeat offender’s advantage, McMahon said. A second DUI conviction comes with a five-year revocation of driving privileges, while the penalty for refusing a breathalyzer test is three years’ suspension.

However, refusing to take the test after a warrant is issued could lead to a contempt of court charge.

Super Bowl Sunday's no-refusal crackdown will be Kane County's eighth.

"We want people to have fun, to watch the Super Bowl, to rate the commercials and to enjoy the camaraderie of family and friends," McMahon said. "But when the game is over, safety and responsibility are in order. Impaired driving is not an option."
